I hereby grant to the Companies, and their designees, assignees and licensees, the worldwide and perpetual right and authority to use, publish, display and reproduce my name, photograph, and other likeness and/or any biographical information I may provide, and any statement I may make or document/artwork or entry I submit (in any media) concerning the promotion or the Prize awarded to me, in any and all media, in perpetuity, for the purpose of trade promotion and/or otherwise, without notification or additional compensation, except where prohibited by law. I agree that the Companies shall not be responsible for any cancellations, delays, diversions or substitutions, or any act or omission whatsoever, by performers or events that are included in the Prize, if any, or by any air carriers or other transportation companies, hotels or other persons providing any travel or event related services or accommodations to passengers, including any changes in services or accommodations necessitated by same. Nor shall the Companies be liable for any loss or damage to baggage or property, or for injury, illness or death, or for any damages or claims whatsoever arising from loss, negligence or delay due to the act, error or negligence of any person not in their direct employ. I understand that it is recommended that I obtain my own travel insurance. I also agree that the Companies shall not be responsible for any cancellation, delay, diversion or changes resulting from any act or omission on the part of me or my guests, or resulting from any act or omission by any governmental entity with respect to me or my guests (including any criminal violations or other disputes that I or my guests may have with governmental authorities), and that the Companies shall have no liability with respect to any such acts or omissions, nor any responsibility to make alternative arrangements for me or my guests with respect to the Prize. No compensation or alternative travel plans will be arranged should the Prize winner and/ or their guest miss their outbound or return flights or fail to meet any check in requirements for any reason. These costs will be the responsibility and expense of the winner and travel partner. I agree that the passenger contracts in use by the airlines or other transportation companies shall constitute the sole contracts with respect to my transportation and such contracts shall be solely between me and such transportation companies. The Companies shall not be parties to such contracts and shall assume no responsibility in this connection. My use of any travel services in connection with the Prize shall constitute agreement and acceptance by me of the terms and conditions of service as specified by the service providers. In the unlikely event that I have any complaints about the hotel or facilities these must be raised directly with the hotel management during my stay. Any issues that could not be resolved satisfactorily must be notified to Mavel Group in writing or by email as soon as possible and will then be processed appropriately, although Mavel Group makes no guarantees that any such complaints will be resolved to my satisfaction. On behalf of myself, my relatives, heirs, assignees, executors and administrators, I hereby permanently, irrevocably and forever waive any and all claims, liabilities, losses and damages (including but not limited to court costs and legal fees) now or in the future of any kind and nature whatsoever (collectively, “Claims”) against the Companies, and their predecessors and successors in interest, assignees, licensees and designees (the "Released Parties") relating in any way to: (i) the promotion, including any sweepstakes therein; (ii) any personal injury, property damage, use of my name or physical likeness as described herein, or any other injury, damage or loss resulting from the promotion, or any travel I undertake in connection with the promotion; (iii) the Prize; and (iv) any acceptance or use of the Prize, and forever release and discharge the Released Parties from any and all liability with respect thereto. I further agree that I will indemnify and hold the Released Parties harmless from and against all Claims arising out of, connected with or as a result of (i) my breach of this agreement and/or (ii) my acceptance and use of the Prize. Without limitation of the foregoing, I agree to return the Prize if any statement made by me is false, or if I breach any of the terms and conditions hereof.
